Purchasers Responsibilities

Due to the nature of equipment sold on ESLI Surveillance website, the purchaser assumes certain responsibilities.

It is the responsibility of the purchaser, and not ESLI Surveillance (EyeSpyL.I.) or its subsidiaries to determine and comply with all federal, state, local laws and government regulations in regard to the purchase, possession and use of all products offered on www.eyespyli.com, www.eslisurveillance.com or www.esliny.com.

Absolutely no sales intentionally will be conducted to minors under 18 years of age. Also, if in one of the following categories:

> Convicted of a crime punishable by imprisonment for any terms.

> Conviction for use of Drug may be shown by recent conviction for use, recent possession of drugs, or recent arrest for use of drugs.

> Aliens illegally or unlawfully within the US or those lawfully admitted in non-immigrant status i.e. aliens without permanent residence status.

> Mentally handicap or persons committed to a mental institution.

> Subject to a court order prohibiting harassing, stalking, or threatening of an intimate partner or child of an intimate partner or placing such persons in reasonable fear of bodily injury.

> Convicted of a misdemeanor crime of domestic violence.

When applicable, products sold may be subject to Public Law 90-351, Title 3, 18 U.S.D., Section 2511. Purchaser assumes all liability or damage resulting from the use, misuse or unlawful use of any of the products offered.

By placing an order, the purchaser represents that he/she is of legal age to receive the products ordered and that the products will be used in a legal and lawful manner in accordance with all applicable federal, state, and local laws.

As no product is 100% effective against attack, ESLI Surveillance assumes no responsibility if any product used in this site is not effective in preventing lawsuits, loss of property, bodily injury, dismemberment, or death.

Returns

The following items cannot be returned: close-out or special order items, custom built including our SecureShot line, redesigned units, modified equipment, digital video recorders (DVR), audio cassette recorders (VCR), damaged equipment due to installation or abuse, and our entire line of counter surveillance items. (see returns policy)

With the prior agreement of ESLI Surveillance, any claim, dispute or controversy arising out of, relating to or concerning this Site and/or this agreement shall be decided by binding arbitration in accordance with the Rules of the American Arbitration Association and any such arbitration proceedings shall be brought and held in Long Island, New York, USA. The decisions of the arbitrators shall be binding and conclusive upon all parties involved and judgment upon any award of the arbitrators may be entered by any court having competent jurisdiction. This provision shall be specifically enforceable in any court of competent jurisdiction.

You agree that ESLI Surveillance may at any time and without notice change the terms, conditions and notices under which this Site is offered.

You agree that no joint venture, partnership, employment or agency relationship exists between you and ESLI Surveillance as a result of this agreement or your use of this Site.

ESLI's performance of this agreement is subject to existing laws and legal process and nothing contained in this agreement is in derogation of ESLI Surveillance's right to comply with law enforcement requests or requirements relating to your use of this Site or information provided to or gathered by ESLI Surveillance with respect to such use.

This agreement, the privacy and security statement, and terms of sale constitute the entire agreement between you and ESLI Surveillance with respect to this site. This agreement supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and ESLI Surveillance with respect to this Site. No modification of this agreement shall be effective unless it is authored by ESLI Surveillance or its affiliates, or unless it is physically signed in blue ink by a ESLI Surveillance officer. Any alleged waiver of any breach of this agreement shall not be deemed to be a waiver of any future breach.
